What is a DUII?

DUII stands for “Driving Under the Influence of Intoxicants.” In the state of Oregon, if an officer pulls you over for driving under the influence of alcohol or a controlled substance, you will be charged with a DUII.

Drunk driving is the common term for being convicted of driving or operating a vehicle while intoxicated. In Oregon, and from a more legal perspective, driving under intoxication can be due to other controlled substances or a combined influence of a substance and alcohol. Thus, Driving Under the Influence (DUI) is not the charge you will receive, but a DUII instead.

Driving under the influence of intoxicants is a serious offense in Oregon and can lead to significant legal consequences. These consequences can include fines, community service, license suspension, and even jail time.

The state of Oregon takes impaired driving very seriously due to the high risk it poses to public safety. The penalties for a DUII are designed to deter individuals from driving under the influence and to encourage those who have been convicted to seek help for substance use issues.

At Another Chance, we recognize the consequences of driving under the influence. We are certified by the state to provide services tailored to those who have received a DUII. In addition to helping you regain your driving privileges, our DUII program also aims to guide, support, and educate you towards living a life free of addiction.

Legal Consequences of a DUII in Oregon

When charged with a DUII in Oregon, the legal process and penalties can be daunting. A DUII conviction can lead to a range of consequences, including:

License Suspension: Under Oregon’s implied consent law, if you refuse to take a chemical test (such as a breathalyzer or blood test) when pulled over, your driver’s license will be automatically suspended. Even if you comply with the test and are found to be over the legal limit, your license may still be suspended.

Fines: The minimum fine for a first-time DUII conviction is typically significant and can increase with subsequent offenses.

Community Service: You may be required to complete up to 80 hours of community service.

Jail Time: A first-time DUII conviction can result in up to 48 hours in jail, with the possibility of a longer sentence for repeat offenders.

Diversion Program: First-time offenders may be eligible to enter a diversion program, which can help avoid a DUII conviction if completed successfully.
